Insurance Coverage Litigation

Maslon has one of the Twin Cities' leading insurance coverage practices that focuses on representing policyholders. Whether the goal is to obtain defense coverage for a lawsuit, maximize insurance proceeds for a catastrophic property or business interruption loss, litigate a complex coverage dispute, or obtain a policy audit or risk assessment, our coverage attorneys proceed with one goal in mind: to ensure that the insurance coverage our clients bought and paid for is there when they need it.

Our lawyers have successfully litigated many of the major Minnesota coverage cases, and we also routinely obtain favorable pre-suit insurance settlements on behalf of our clients. Our expertise includes all types of insurance, including commercial general liability (CGL), product liability, property, business income, crime and fidelity, directors and officers (D&O), professional liability (E&O), employment practices liability, cyberliability, representation and warranties, worker's compensation, and recall coverage. Our clients also include commercial entities that are self-insured or have large retentions; and we help them to provide defense, liability, and claims-handling services to obtain protection under reinsurance and excess insurance programs.

Insurance Coverage Counseling
Coverage litigation is not all we do, however. We also try to help clients avoid litigation where possible by providing coverage counseling and advice on the front end, on a wide array of issues. Our coverage counseling includes policy audits, coverage assessments for potential losses and risks, and help with negotiating favorable coverage terms when insurance is being purchased or renewed. During corporate transactions, we help our clients with insurance due diligence, contract drafting relating to insurance and indemnification, and ensuring that the parties' allocation of risk and long-tail liabilities are properly insured.

On the insurer side, Maslon's insurance coverage attorneys represent some of the country's leading life insurers, as well as the Minnesota Life and Health Insurance Guaranty Association, in litigation and regulatory matters. We have also assisted these clients in obtaining successful results in sales practices, ERISA, and other significant litigation matters.
