Maslon Helps World's Largest Construction Company Eliminate Exposure of $27 Million from Las Vegas Raiders (Allegiant) Stadium Project

A Maslon team led by David Suchar helped Freyssinet, Inc., and parent entity VINCI—the world’s largest construction company—eliminate exposure of $27 million in claims regarding a failure on the $2.1 billion Allegiant Stadium Project.
In 2016, Mortenson-McCarthy Joint Venture (“MMcJV”) was hired as design-build contractor for the 1.8-million-square-foot stadium for the NFL’s Las Vegas Raiders. In 2018, MMcJV subcontracted with Freyssinet to build the stadium’s cable-net roof structure. This included sequencing and lifting the roof system from the stadium floor onto the steel compression ring—provided by a separate subcontractor—of the stadium’s superstructure. In October 2019, during Freyssinet’s installation, the roofing system disconnected from the steel compression ring, delaying construction for months. Through arbitration, MMcJV brought over $27 million in claims against Freyssinet for its alleged role in the incident.
Freyssinet hired Suchar after it was denied coverage by several insurance carriers. Suchar's team helped the company obtain complete recovery for the settlement of the claims against it, plus defense costs. They accomplished this through the successful prosecution and settlement of a lawsuit the team brought in the U.S. District Court for the District of Nevada against the project’s primary commercial general liability insurer, Lloyd’s of London, as well as a series of mediation victories while working with a variety of insurers and project parties.
