Session 1 | Navigating Workouts in Today's Economic and Legal Landscape

This panel will delve into workout strategies against the backdrop of the current economic climate as well as recent national bankruptcy and local state court decisions. To set the stage, attendees can expect a brief presentation on key developments from 2025: filing trends, foreclosure activity, and macroeconomic indicators affecting credit. Local workout leaders will then offer practical lending and legal perspectives on early intervention, leverage negotiation, and risk management in today’s environment. Attendees will leave with concrete insights into how lenders are adapting their workout approaches and preparing for the next phase of the credit cycle.

Session 2 | Five Things Every Bank Should Understand About Lender Liability Insurance

This session will focus on lender liability insurance and address five important and practical issues every bank should understand to maximize the protection its insurance is meant to provide. These issues include claim recognition and insurance notice requirements and pitfalls, the breadth and scope of lender liability coverage, common policy exclusions and limitations, and when seeking advice and assistance from an insurance coverage lawyer is critical.
