Maslon Litigation Group attorneys James Long and Jevon Bindman have co-authored an article for the American Bar Association Franchise Law Journal. In the article, titled "Equitable Recoupment: A Limited Remedy for Dealer or Franchise Terminations When Statutory Protection Is Absent," Jim and Jevon describe how equitable recoupment may provide limited recovery for a terminated distributor who lacks a statutory remedy.

Jim Long has over 35 years' experience trying cases in the areas of antitrust, franchise, and dealer/distribution law. He has successfully represented clients in multiple state and federal courts across the country; tried antitrust and dealer termination jury cases to conclusion; responded to state AG, DOJ, and FTC investigations; handled numerous arbitrations; and argued appeals in the Seventh and Eighth Circuit appellate courts.
Jim regularly counsels clients on a wide variety of antitrust issues and teaches antitrust law as an adjunct professor. He represents franchisors in disputes with franchisees and manufacturers in disputes with dealers, distributors, or sales representatives. He has handled cases, and counsels clients, on matters involving the Minnesota Franchise Act; Minnesota Sales Representative Act; Minnesota Heavy and Utility Equipment Manufacturers and Dealers Act; Minnesota Agricultural Equipment Dealership Act; Wisconsin Fair Dealership law; a number of state motor vehicle and power sport dealer's acts; and other industry specific dealer and distribution laws.
Jevon Bindman focuses his work on construction, insurance coverage, and appellate litigation as well as antitrust and general commercial matters. He has taken numerous complex matters to jury verdict, and helps both Fortune 500 companies and "mom and pop" operations to navigate all phases of the litigation process. Jevon has significant experience in contract disputes, franchise and competitive practices claims, policyholder insurance coverage claims, construction defect and mechanic’s lien claims, and shareholder disputes. He also regularly handles appeals in the Eighth Circuit and Minnesota appellate courts.
