January 26, 2021

Erica Holzer, Jevon Bindman, and David Herr, attorneys in Maslon's Litigation Group, will present at Minnesota CLE's 2021 Civil Litigators Update on January 26, 2021. David and Erica, co-chairs of the program, will kick off the half-day virtual seminar with a welcome and introduction. Jevon will present a session titled "New Minnesota and Federal Rules," where he will discuss recent developments relating to the Minnesota Civil Rules, General Rules of Practice, and Rules of Civil Appellate Procedure, as well as their federal counterparts, including a focused look at the most recent amendments.

Erica represents clients in complex commercial disputes primarily in the areas of tort and product liability, consumer fraud, business torts, and breach of contract actions. Erica's product liability defense work spans many industries, with particular experience in FDA-approved medical devices, representing a major medical device manufacturer in federal and state courts throughout the country. She has also developed specialized experience providing advice and compliance support to government contractors and companies on public law issues, particularly state and federal open records laws, including the Minnesota Government Data Practices Act and the federal Freedom of Information Act. Erica is also an experienced appellate attorney. She has authored, co-authored, and edited dozens of appellate briefs, and is frequently sought out to provide advice on appeals in the Eighth Circuit and the appellate courts of Minnesota.

Jevon focuses his work on construction, insurance coverage, and appellate litigation as well as general commercial matters. He has represented Fortune 500 companies and "mom and pop" operations alike to help his clients navigate all phases of the litigation process, from pre-suit negotiations to litigating and resolving claims. He has significant experience in contract disputes, policyholder insurance coverage claims, construction defect and mechanic’s lien claims, and business litigation. Jevon has significant trial practice experience, having taken complex construction matters to jury verdict. He is skilled in all stages of pre-trial civil litigation, including leveraging written discovery and deposition testimony to improve settlement position, drafting successful dispositive motions to avoid trial risks, and working with expert witnesses. Jevon also regularly prosecutes appeals in the Eighth Circuit as well as in Minnesota appellate courts.

David is a highly regarded appellate lawyer and complex case litigator. He is frequently sought out to provide practical and sophisticated advice on how to resolve difficult, multi-party disputes in trial courts and arbitral forums as well as in the appellate courts. David is past president of the American Academy of Appellate Lawyers, past president of the Academy of Court Appointed Masters, and regularly argues cases in the Minnesota appellate courts and the Eighth Circuit Court of Appeals. He annotates the Federal Judicial Center's Manual for Complex Litigation, published and distributed nationally by Thomson West. He is also the Reporter for the Minnesota Supreme Court’s Advisory Committees on Civil, General, and Civil Appellate Rules.
