Andrew Page Co-Authors Article on Real Covenants for American Bankruptcy Institute Journal
February 6, 2023
Financial Services attorney Andrew Page has co-authored an article for the February 2023 issue of the American Bankruptcy Institute Journal. The article, titled "Unbundling a Bundle of Sticks," analyzes "real covenants" and their ability under state law to attach to and become inseparable from their underlying land, even when the land is transferred to new owners who did not agree to the covenants. Drew and his co-authors then explain how sections 363 and 365 of the Bankruptcy Code can provide debtors and trustees with the tools to free property from real covenants that burden the land and diminish value.
