Maslon Client Prevails at Trial Against Competitor's Allegations of False Advertising

A federal jury returned a favorable verdict Monday for Maslon clients KV Pharmaceutical Company (NYSE: KVa/KVb) and its subsidiary ETHEX Corporation on claims of false advertising and unfair competition brought by a competitor. The plaintiff, a manufacturer of a brand-name pancreatic enzyme supplement, sought significant damages for KV and ETHEX's marketing of a competitive generic enzyme supplement. The jury rejected the competitor's claims, finding for the defendants on all counts and awarding no damages.

Maslon served as local counsel for KV and ETHEX and tried the case in Minnesota federal district court over a period of seven weeks alongside a team of counsel from the law firm of Patterson Belknap Webb & Tyler LLP of New York (www.pbwt.com).
